WEST NEW YORK – Dr. Felix Roque, leader of the “Together We Can” group seeking to recall Mayor Silverio “Sal” Vega and the four other commissioners, is gearing up for a fight in court.
On Friday, Roque’s attorney, Arthur Neiss, submitted a brief to Superior Court Judge Maurice Gallipoli that challenges Town Clerk Carmela Riccie’s determination in December that the committees did not submit enough valid signatures to initiate the recall elections.
The group needed 5,256 valid signatures for each commissioner to proceed.
According to Riccie, of the 31,235 petitions the group filed, 14,167 signatures — 45.4 percent were invalid.
The 30-page brief argues that Riccie incorrectly invalidated at least 3,298 signatures in which personal information, such as the name and address of the signer, had been filled in by someone other than the signer.
